Terms of Service — Rhime USA

These Terms govern your access to and use of rhimeusa.com and any purchase from Rhime USA (“Rhime,” “we,” “us,” “our”). By using the site or placing an order, you agree to these Terms and to our Privacy Policy and Return & Refund Policy. If you do not agree, do not use the site.

Consumer law notice (EU/UK/AU and other jurisdictions): Nothing in these Terms limits rights you are guaranteed by mandatory consumer protection laws (e.g., the EU Consumer Rights Directive/legal guarantee of conformity, UK Consumer Rights Act). Where these laws apply, they prevail over any conflicting term below.

1) Eligibility & accounts

  • You must be at least the age of majority in your place of residence to purchase. If you are under the age of majority, a parent/guardian must make the purchase.

  • You are responsible for keeping your account credentials confidential and for all activity on your account. We may refuse, suspend, or close accounts at our discretion.

2) Orders, acceptance & availability

  • Your order is an offer to buy; we accept only when we charge your payment method and confirm shipment.

  • We may refuse or cancel any order (e.g., suspected fraud, pricing/stock errors, shipping restrictions, reseller quantities). If we cancel after a charge, we’ll promptly refund the charge.

  • We may limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

3) Pricing, taxes & currency

  • Prices are shown in the currency indicated at checkout and exclude taxes, duties, and shipping unless stated otherwise.

  • You authorize us to collect applicable taxes at checkout. International customers are responsible for any import duties, VAT/GST, and brokerage fees on delivery.

4) Payment

  • We accept the payment methods displayed at checkout. By submitting a payment, you represent that you are authorized to use that method and you authorize us (and our payment processors) to charge it for the order total.

  • We use third-party processors; we do not store full card details.

5) Shipping, risk of loss & title

  • Shipping options, fees, and ETA are shown at checkout.

  • US customers: Title and risk of loss pass when the carrier delivers to your address.

  • EU/UK customers: Risk passes when you physically receive the goods, as required by law.

  • We are not liable for delays after timely handoff to the carrier. Address changes may not be possible after the order is placed.

6) Returns, refunds & exchanges

  • Returns are governed by our Return & Refund Policy (15-day window; EU/UK withdrawal rights preserved). Shipping charges are non-refundable except where required by law.

  • We may refuse returns that do not comply with the Policy (e.g., worn/used goods, missing packaging).

7) Product information & fit

  • We try to display colors and details accurately, but display/device differences may occur.

  • Sizing/fit guides are advisory. Use indoors on a clean surface when trying on footwear to keep the item return-eligible.

8) Promotions, bundles & gift cards

  • Promotions are for a limited time and subject to the specific terms stated. We may modify or end a promotion at any time.

  • Bundles/gifts with purchase require returning the complete bundle/gift for a full refund; otherwise deductions may apply.

  • Gift cards are non-refundable and not reloadable; lost or stolen cards will not be replaced.

9) Intellectual property & license to use the site

  • The site, products, images, videos, trademarks, logos, and all content are owned by Rhime or its licensors and are protected by law.

  • We grant you a limited, non-exclusive, non-transferable license to access and use the site for personal, non-commercial shopping only.

  • Prohibited: copying/scraping content or data; reverse engineering; using bots; framing or linking to misrepresent affiliation; using our marks without written permission.

10) User content (reviews, posts, submissions)

  • If you submit content (e.g., reviews, photos), you grant Rhime a worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display that content in any media for marketing or operational purposes.

  • You represent that you own or have rights to the content and that it is truthful, lawful, and non-infringing. We may moderate or remove content at our discretion.

11) Mobile messages (if you opt in)

  • By opting in to SMS or similar mobile messages, you consent to receive automated marketing messages; consent is not a condition of purchase. Message/data rates may apply. Reply STOP to cancel, HELP for help. Frequency varies.

12) Warranties & statutory guarantees

  • To the maximum extent permitted by law, the site and all products are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by law.

  • EU/UK consumers: You have a legal guarantee that goods conform to the contract for at least the minimum period mandated by law (typically 2 years). If goods are non-conforming, you are entitled to remedies such as repair, replacement, or refund as provided by law.

13) Limitation of liability

  • We do not exclude or limit liability where it would be unlawful to do so (e.g., for death or personal injury caused by our negligence, fraud, or for your statutory rights).

  • Otherwise: To the fullest extent permitted by law, Rhime and its affiliates, officers, employees, and agents will not be liable for any:

    • indirect, incidental, special, consequential, exemplary, or punitive damages; or

    • loss of profits, revenue, data, goodwill, or business interruption;
      arising out of or related to your use of the site or purchase of products, even if advised of the possibility.

  • In all cases where liability cannot be excluded, our total aggregate liability for any claim shall not exceed the amount you paid to Rhime for the product(s) at issue.

14) Indemnity

You agree to indemnify and hold Rhime harmless from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the site, or your violation of laws or third-party rights.

15) Export, sanctions & geographic restrictions

You may not purchase or use our products in violation of applicable export control, sanctions, or embargo laws. We may restrict sales or shipping to certain locations.

16) Dispute resolution, governing law & venue

  • United States residents: These Terms and any dispute are governed by the laws of the State of California (without regard to conflict-of-law rules) and applicable U.S. federal law.

    • Binding arbitration & class action waiver: Except for small-claims cases or claims for injunctive relief, disputes will be resolved by final and binding arbitration on an individual basis. Class or representative actions are not permitted. You may opt out within 30 days of your first purchase by emailing Support@Rhimeusa.com with subject “Arbitration Opt-Out” and your order number.

    • Venue: For any court cases permitted (e.g., small claims, injunctive relief), the exclusive venue is the state or federal courts in Los Angeles County, California.

  • EU/UK consumers: You may bring claims in the courts of your place of residence and under the mandatory laws of your country. You may also access the European Commission’s online dispute resolution (ODR) platform; this does not obligate us to use any specific ADR provider.

  • Other regions: Where mandatory law gives you specific venue or consumer rights, those rights remain unaffected.

17) Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control (e.g., acts of God, labor disputes, epidemics, carrier failures, supply shortages, government actions).

18) Changes to the site or Terms

We may modify the site, our policies, or these Terms at any time. Changes apply from posting on the site and will not retroactively affect completed orders. Your continued use constitutes acceptance.

19) Assignment

We may assign or transfer our rights and obligations under these Terms. You may not assign without our prior written consent.

20) Severability & waiver

If any provision is found unlawful or unenforceable, it will be replaced with a valid term that best reflects the original intent, and the remaining provisions remain in effect. Our failure to enforce a right is not a waiver.
